Rental Terms & Conditions

By renting from PANI Enterprises, dba Weather or Not, the Renter agree to the following terms and conditions: 

Use of Products

That this personal property is rented to Renter by Weather or Not to be used by the Renter for the stated period and to be used solely for the purposes for which said items were manufactured and intended. Customer is responsible for rental items from time of pick-up or delivery to the time of drop-off to Weather or Not or the appropriate shipping facility.

Renter’s Responsibilities

That Renter or their agent will personally inspect the personal property upon receipt and that he/she fully understands its proper use and that it meets his/her requirements.

Renter, upon termination of this contract, will immediately return the rented personal property, with all attachments, accessories and parts thereof to Weather or Not in good condition and repair, subject to reasonable wear and use. "Return Date" constitutes the date the items should be shipped back or dropped off at Weather or Not. If the order is not dropped off to UPS or Weather or Not warehouse on the "Return Date" by 4:00 pm local time, a daily charge of 25% of the total rental fee will be assessed, with a minimum of $25 per day for each day late. After three (3) days, Weather or Not will regard these as unreturned items and will charge the prices listed in #6 for all unreturned items. Weather or Not will auto-charge the credit card on file for any and all late fees. All late and replacement fees are non-refundable. The Renter hereby certifies that they are duly authorized to execute this form on behalf of the account holder. If the credit card on-file is invalid for any reason, the Renter shall be held liable for all outstanding balances.

Renter agrees that they may only decrease quantities up to 10% at 14 days prior to "Delivery Date". At 7 days prior to "Delivery Date", only increasing quantities will be permitted (based on availability); no decrease will be permitted.

Damage Waiver

Weather or Not applies a required non-refundable Damage Waiver to the cost of all rental items. This industry-standard waiver covers reasonable physical damage to up to 10% of the rented items and is NOT liability insurance. This waiver DOES NOT include: theft, vandalism, neglect, misuse, destruction, unreturned items, or losses due to war, acts of terrorism, hail, sleet, snow, or any other acts of God. If items are damaged to the point that they are unrentable, we consider the items as "unreturned" and will bill accordingly as mentioned below. 

Minor damage to shawls and blankets are covered by Damage Waiver. Any lost products or will be charged for replacement, including but not limited to: holes, burns, tears, and stains.

Umbrellas: Renter is responsible for drying umbrellas completely by opening and either air-drying or wiping down the umbrellas. The umbrellas shall be carefully boxed to prevent mechanical damage.

Unreturned Items:  For any unreturned rental items, the Renter will be charged the following fees:

Weather or Not maintains the right to charge the credit card on file for any additional fees. Loss fees are subject to change at any time.

In the case of damage of the rented equipment for any cause, Renter must still return items to Weather or Not by the return date. Renter particularly understands that without Weather or Not authorization, Renter has no authority to incur any expense on a Weather or Not account for the repair of said items.

Liabilities

Renter promises to hold Weather or Not harmless and free from any and all liabilities, of any and every nature whatsoever, arising out of the use, maintenance, or return of the equipment. That Renter shall indemnify and hold Weather or Not, its members, agents, and employees harmless from all damages to third persons or their property caused by Renter or their guests in possessing or operating the items, including legal fees and costs incurred in defense of such claims. In the event of an accident or collision involving any of the items, Renter agrees to furnish Weather or Not with a complete report of the same, including names, an address of all witnesses and parties involved, and a copy of any police report, and further that the equipment will be used by the Renter and/or the persons herein designated, and no other person, without the consent of Weather or Not. The sole liability of Weather or Not is limited to the amount of the rented order.

Extension of Rental Period

If Renter desires to extend this contract beyond the date and time originally agreed upon, Renter will immediately notify Weather or Not of this desire and obtain the terms of extension and approval from Weather or Not. If extension is not requested and granted, the daily charges listed above will be assessed.

Breach of Contract

If by reason of any breach of the contract by Renter, termination of this contract, failure to pay rental fees, insolvency of the Renter, or any other reason it becomes necessary for Weather or Not to retake their personal property, Weather or Not and its agents shall be permitted and they are hereby authorized to go upon Renter's property and collect the equipment, without any legal process. Weather or Notand its agents may use such reasonable force as is necessary to retake the equipment and Renter hereby expressly waives for himself, agents and employees all claims for damages and losses, physical and pecuniary, caused by retaking by Weather or Not. Renter agrees to pay all reasonable costs and expenses incurred by Weather or Not in retaking the equipment and in collections of sums due under this contract. Should Weather or Not employ legal counsel to assist in the recovery of the equipment or any sums due under this contract, Renter agrees to pay all reasonable costs, expenses, and attorney's fees incurred by Weather or Not.

Refunds

All payments are non-refundable. However, Weather or Not will fully refund payments for items not available on the rental date if comparable items are also not available.

Use of Images

The Renter agrees to permit Weather or Not to use images of the event in promotions and portfolio, without compensation to Renter.

Payment

In exchange for products and/or services listed on the Rental Agreement, the Renter agrees to pay Weather or Not the amount listed. The Renter hereby authorizes PANI ENTERPRISES LLC dba Weather or Not to electronically draft via the Automated Clearing House system, or to charge the credit card on file with the credit agreement used to pay this particular contract, the amounts indicated at Weather or Not's discretion. This authority will continue until withdrawn in writing by the account holder. Renter acknowledges that Renter is subject to a $50 return fee for returned checks. Renter agrees to pay interest at the rate of 1.5% per month or at the highest rate permitted by law, whichever is lesser, upon all delinquent accounts, and further agrees to pay upon demand all reasonable collection costs and attorney's fees incurred in the collection of this account, or in reinforcing any of the terms of this agreement.

That Renter agrees to pay any and all taxes, sales and use that do or may arise out of this agreement.

That the failure of Weather or Not at any time to insist upon strict performance by the Renter of the conditions and terms of this contract shall not be construed as waiver of Weather or Not's right to demand strict performance.

Rush Orders

A rush fee is automatically applied on all orders placed within 24 hours of "Delivery Date". This fee is separate from expedited shipping costs.

Shipping

We ship within the 48 contiguous states. Shipping charges will be applied on purchases.

Warehouse Pick-Up

If you’re our neighbor in Colorado, you can pick-up your order from our warehouse in Denver at 5310 Tennyson St. Denver, CO 80212 (near I-70 & Sheridan Blvd.)! Just make sure you notify your salesperson. And… you can call (303) 578-8889 ext. 104 for directions.

Returns

Unfortunately, we cannot accept returns on personalized items (products that have been embroidered, silk screened, etc.). For non-personalized items, please contact us to discuss returns. Please contact us as soon as possible, and we will do our best to accommodate your needs. Returns will be honored within the first 10 days after you receive your items.
